If as U.S. citizen marries a foreign citizen abroad the U.S. citizen must return to the USA and file a spousal visa petition.  In some cases the foreign citizen is in the USA and marry they will have to observe the rules of the visa they used to enter the USA and return to their country waiting for the approval of spousal visa petition.

The K3 visa petition is a two part process.  The U.S. citizen must first file an I-130 application with the USCIS when the U.S. citizen received the receipt notice for the first application and I-129F application must be filed.

After approval of the application it will be forwarded to the National Visa Center.  The process of k3 spousal visa can be very confusing to many people.  If the I-129F is approved first the application will be sent directly from the National Visa Center to the Consulate in the country of the foreign spouse.  The process than works much like the K1 fiancée visa process and interview will take place in a reasonable amount of time.

In the event the I-130 is approved first the National Visa Center will contact the U.S. citizen asking for more fees to complete the processing.  This usually delays the process about two months before the approved petition is forwarded to the U.S. Consulate.

We will be happy to assist you with either visa.  The K3 spousal visa generally takes longer than the K1 fiancée visa and it is more expensive to prepare.  There is more paperwork involved that the K1 and there are more government fees as well.  If you are already married the k3 spousal visa is the visa that you will need to file.  If you are not married and want to get your love one here as fast as possible you may consider the K fiancée visa.
